Terms of Service

The terms that govern your use of Tolinks. Please read them carefully — by using the Platform you agree to be bound by them.

1. Acceptance of Terms

These Terms of Service (“Terms”) are a legally binding agreement between you (“you”, “your”, “User”) and Tolinks (“we”, “us”, “our”, operating at tolinks.in) governing your access to and use of the Tolinks website, application, and services (together, the “Platform”).

By creating an account, signing in, accessing any page hosted on the Platform, or otherwise using the Platform, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and our other policies referenced herein. If you do not agree to these Terms, you must not use the Platform.

You may use the Platform only if you are at least 18 years old and capable of forming a binding contract. If you use the Platform on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Service

Tolinks is a link-in-bio and micro-site platform. It lets you create a public profile page (a “Page”) at a custom handle (for example, tolinks.in/@yourname) where you can display links, buttons, text, images, QR codes, embedded media, newsletter collection forms, and lead forms, and share that page with your audience. The Platform also provides account management, page analytics, profile images, and paid subscription plans.

We may add, modify, or remove features from time to time, including as part of plan tiers. Substantial reductions in functionality will be notified in advance where reasonably practicable. We are not liable for any loss arising from the modification, suspension, or discontinuation of any feature, except where required by law.

Availability: we aim for high availability of the Platform but do not guarantee uninterrupted or error-free operation. Scheduled maintenance and force-majeure events (including network, infrastructure, or third-party provider outages) may cause temporary unavailability, for which we will make reasonable efforts to give notice where practicable.

Support: self-service documentation and support are available through the Contact page and support@tolinks.in. Paid plans are supported with priority response but the response-time targets are best-effort, not contractual commitments.

3. Accounts and Registration

  • You must provide accurate, current, and complete information when registering, and keep it up to date.
  • You must not create multiple accounts to evade restrictions, filters, or bans, or to misrepresent your identity.
  • You are responsible for safeguarding your credentials. You must not share your password or permit others to access your account. Where feasible, we strongly encourage enabling email verification.
  • We may refuse registration, suspend, or terminate any account at our discretion where permitted by law, including where the account name, handle, or content violates these Terms or the Acceptable Use Policy.
  • Your handle is allocated to you while your account is active. Handles of deactivated or terminated accounts may be released for reuse at our discretion.

4. Subscriptions and Payments

The Platform offers a free tier and paid subscription plans (such as the Pro plan), as described on the Pricing page. Prices, plan features, and renewal terms are as displayed at the time of purchase (in INR, India time), and all payments are processed in Indian Rupees unless otherwise stated.

By purchasing a subscription you agree to pay the applicable fees through our payment processor, Razorpay, and authorise recurring charges for the plan you select, at the intervals shown at checkout, until you cancel. You are responsible for all charges, including taxes, except where we state that tax is included.

Subscriptions renew automatically until cancelled. You may cancel at any time from the Account → Billing area; cancellation takes effect at the end of the then-current billing period and you will retain access until then. Except as stated in the Refund Policy, fees already paid are non-refundable, and any free period granted at sign-up is at our sole discretion and non-transferable.

If a payment fails (for example, an expired card), we will notify you; your page may be temporarily placed in a limited state or your subscription may lapse, in which case you will retain access to the free tier. We are not liable for loss of paid features due to failed payments if you were notified.

5. Your Content

You retain all rights in the content you publish on your Page (“Your Content”). By publishing it on the Platform, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, publicly display, distribute, and process Your Content solely as needed to operate, provide, and improve the Platform — including rendering your Page, thumbnail and link previews (OG images), analytics, caching by content delivery networks, and search-index snippets.

You represent and warrant that: (i) you own or have the necessary rights to Your Content; (ii) Your Content does not infringe the intellectual property or other rights of any third party; (iii) Your Content complies with these Terms and the Acceptable Use Policy; and (iv) if Your Content includes personal data of third parties, you have obtained it lawfully and with consent as required by applicable law (including the DPDP Act, 2023).

We may remove content without notice if we reasonably believe it violates these Terms, the Acceptable Use Policy, applicable law, or the rights of others.

6. Acceptable Use

You agree not to misuse the Platform. Without limiting the full Acceptable Use Policy, you must not:

  • Use the Platform in violation of any law, regulation, court order, or the rights of third parties;
  • Upload, publish, or link to unlawful, infringing, deceptive, or malicious content (including malware, phishing, or content designed to steal credentials);
  • Harass, bully, defame, or threaten any person, or publish content that is obscene or pornographic in a manner that violates applicable law;
  • Circumvent access controls, rate limits, security measures, or technical protections, or probe the Platform's infrastructure without authorisation;
  • Resell, lease, or sublicense the Platform or your subscription, or offer hosting of pages for third parties in a way that undermines the service;
  • Impersonate any person or organisation, or misrepresent your affiliation with Tolinks.

7. Intellectual Property

The Platform — including its code, design, trademarks (including “Tolinks”, its word mark and logos), text, graphics, and materials — is owned by us or our licensors and is protected by Indian and international intellectual property laws. Except for Your Content, no part of the Platform may be copied, modified, distributed, or republished without our prior written permission. Nothing in these Terms grants you any right in, or licence to, our trademarks, copyrights, or other proprietary rights.

If you believe content on the Platform infringes your copyright or other rights, see the Copyright Policy, which sets out the notice process (including the procedure under Section 79 of the IT Act, 2000 and the IT Rules, 2021).

8. Third-Party Links and Services

Your Page and the Platform may contain links, buttons, embeds, and references to third-party websites and services that we do not control. We are not responsible for, and make no representations about, the content, practices, or availability of those services, and we do not endorse them. Your interactions with them are solely between you and the third party, and may be subject to their own terms and privacy policies.

Payment processing is provided by Razorpay; by purchasing, you also agree to Razorpay's terms and privacy practices as applicable to you.

9. Third-Party Content and Users

The Platform may display content created and published by other users of the Platform (for example, other users' Pages and profiles). We do not review, endorse, vet, or warrant such content, and we are not liable for it. Interactive content — including newsletter forms, lead forms, surveys, and contact buttons — is provided by the owning user, and any information you submit through such content is provided to that user, subject to their own privacy practices and to the Privacy Policy as it applies to them.

You should exercise appropriate judgement when interacting with third-party users and when deciding what information to share.

10. Privacy

Our handling of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the processing described there. Where you use lead, newsletter, or visitor features, you are responsible for complying with data protection law in your own processing of the personal data collected through your Page.

11. Termination

  • By you: you may close your account at any time from the dashboard or by contacting support. Your Page will be removed from public view (following a short grace period for recovery), and your data will be deleted per the retention schedule in the Privacy Policy. Paid features remain available until the end of the paid period.
  • By us: we may suspend or terminate your account, delete or restrict content, or cease providing the service, with or without notice, if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or applicable law, or if continued operation would create legal, security, or reputational risk. Where feasible and lawful, we will notify you and give you an opportunity to address the issue.
  • Effect: provisions which by their nature survive termination — including Sections 5, 7, 9, 12, 13, 14, and 15 — will survive.

12. Disclaimers and Limitation of Liability

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that the results of using the Platform will meet your expectations.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of (or inability to use) the Platform, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or in connection with these Terms or your use of the Platform will not exceed the greater of: (i) the amounts you have paid to us in the twelve (12) months preceding the claim, or (ii) ₹500. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.

13. Indemnity

You agree to indemnify, defend, and hold harmless Tolinks, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (i) Your Content or your Page; (ii) your use of the Platform; (iii) your breach of these Terms, the Acceptable Use Policy, or any applicable law; or (iv) any third-party claims arising from personal data you collect through your Page.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of India. Any dispute, controversy, claim, or difference arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at Bhubaneswar, Odisha, India, to the extent permitted by law.

15. Changes to These Terms

We may revise these Terms from time to time. We will provide reasonable notice of material changes, including by emailing registered users. Changes become effective on the date stated. If you continue to use the Platform after such date, you accept the revised Terms. If you do not agree to the revised Terms, you may close your account before they take effect.

16. General Provisions

  • Entire agreement: these Terms, together with the policies referenced herein, constitute the entire agreement between you and us regarding the Platform.
  • Severability: if any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain in force.
  • Waiver: failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment: you may not assign or transfer your rights under these Terms. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
